Terms of Service

These terms are the agreement between you and Azul Services (Azul-Services, LLC), Las Vegas, Nevada (“we”, “us”) for using ProbeKit. By creating an account or using ProbeKit you agree to them. If you use ProbeKit for a company, you agree on its behalf and confirm you are allowed to.

1. What ProbeKit is

ProbeKit is a set of network, DNS and email diagnostic tools, with optional monitoring, alerting, hosted DMARC reporting, AI explanations and an API. Results are point-in-time readings of systems we don’t control. They can be incomplete or wrong, and they are not professional advice: check before you change production systems.

2. Your account

• You must be at least 16 and able to enter into a contract.
• Give a real email address you control, keep your sign-in methods safe, and tell us if you think your account was misused.
• You are responsible for what happens under your account and your API keys.
• An organization’s owner is responsible for the people they invite and the plan the organization uses.
• One free account per person: don’t open extra accounts to get around plan limits.

3. Using ProbeKit responsibly

Only check domains, IP addresses and hosts that you own or are authorized to assess, and follow the Acceptable Use Policy. It is part of these terms.

4. Plans, billing and trials

• The Free plan costs nothing. Current paid plans, limits and prices are on the Plans page.
• Paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically until you cancel. Prices exclude taxes, which are added where the law requires.
• A free trial, where offered, lasts 14 days (30 days for an organization that signs up through another customer’s referral link), needs a payment card, and is limited to one per organization. You are charged when the trial ends unless you cancel before then; we email you 3 days before it ends.
• You can cancel at any time; your plan stays active until the end of the period you paid for. Refunds follow the Refund and Cancellation Policy.
• We may change prices. A change applies from your next renewal, and we email paying customers at least 30 days before it does.
• If a payment fails and isn’t fixed, the organization moves to the Free plan and Free limits apply.

5. Your data

Your monitors, settings, DMARC data, results and other content stay yours. You give us permission to store and process them only as needed to run ProbeKit for you, as described in the Privacy Policy and, for business customers, the Data Processing Addendum. You are responsible for having the right to give us any personal data in your content (for example the alert recipients you add).

6. Our service and feedback

ProbeKit’s software, design, content and brand belong to us. These terms don’t give you any rights to them except to use the service. If you send us ideas or feedback, we may use them without owing you anything.

7. API

API keys are for your organization. Don’t share or publish them. The API is subject to your plan’s quotas and to rate limits, and we may change it; we’ll give notice before removing an endpoint that paying customers use.

8. Availability and changes

We work to keep ProbeKit available and accurate but don’t promise any particular uptime. We may add, change or remove features. If we remove something a paid plan includes, we’ll tell you in advance and, if you cancel because of it, refund the unused part of what you prepaid.

9. Suspension and termination

• You can stop using ProbeKit and delete your account at any time from the Account page.
• We may limit, suspend or close an account that breaks these terms or the Acceptable Use Policy, doesn’t pay, or puts the service or other people at risk. Where it is safe to do so we’ll warn you first and give you a chance to fix things.
• We may also end the service, or your account without cause, with 30 days’ notice and a refund of any prepaid time you won’t be able to use.

10. Disclaimer

ProbeKit is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and that the service will be uninterrupted or error-free. We don’t guarantee that following any result, alert or AI explanation will fix a problem or get your mail delivered.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about ProbeKit is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. These limits don’t apply where the law doesn’t allow them, such as for fraud.

12. Indemnity

If someone makes a claim against us because you used ProbeKit against systems you weren’t authorized to assess, or otherwise broke these terms, you agree to cover our reasonable costs of that claim.

13. Governing law

These terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws rules. Disputes go to the state or federal courts in Clark County, Nevada, and both sides agree to their jurisdiction. If you are a consumer, you keep any protections the law of your country gives you that can’t be waived.

14. Changes to these terms

We may update these terms. We change the date above when we do, and for changes that matter we email account holders at least 14 days before they take effect. If you keep using ProbeKit after that, the new terms apply; if you don’t agree, you can cancel and delete your account.

15. The rest

These terms, together with the policies they link to, are the whole agreement about ProbeKit. If a part can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver. You can’t transfer these terms without our agreement; we can transfer them to a company that takes over ProbeKit. Notices to you go to your account email; notices to us go through our contact form.
